PLEASE TAKE NOTICE that the County of Alleghany (hereinafter the “County”) has received an offer for the purchase of certain real property owned by the County as described herein below and proposes to sell the same pursuant to the provisions of G.S. §160A-269. Said property is situated in Gap Civil Township, Alleghany County, North Carolina, and is more particularly described as follows:
Beginning at a point at curb of Highway #21, at southwest edge of sidewalk, E.L. Williams and C.W. Ervin’s corner, running North 47 ½” East 200 feet with Williams and Ervin line fence to an iron stake; North 41 ½” West 60 feet to an iron stake; South 47 ½” West 200 feet to curb of Highway #21; South 41 ½” East 60 feet with Highway to the Beginning. Tax parcel ID 3071601194.
The above described property was acquired by the County of Alleghany under a General Warranty Deed dated November 19, 2004, and recorded at Book 276, Page 532, Alleghany County Register of Deeds.
The County has received an offer of FIFTY-SEVEN THOUSAND SEVEN HUNDRED FIFTY AND 00/100’s ($57,750.00) DOLLARS. A deposit of 5% (FIVE PERCENT) has been received along with said offer. Within ten (10) days of the date hereunder any person may raise said offer by filing an upset bid in writing, stating the amount of the new offer and the name and address of the offeror. The upset bid shall be in an amount of no less than SIXTY THOUSAND SEVEN HUNDRED THIRTY-SEVEN AND 50/100’s ($60,737.50) DOLLARS, plus the cumulative costs of publication for this Notice and the recording costs for the a Deed from the County to the buyer. Upset bids shall be delivered to Michael James, County Manager, Post Office Box 366, Sparta, NC 28675 (Physical Address: 348 South Main Street, LL80, Sparta, NC 28675), no later than 5:00 P.M. on March 29, 2019, and shall be accompanied by a deposit in the amount of FIVE (5%) PERCENT of the new offer in cash, or by certified or personal check made payable to Alleghany County. Upset bids, if mailed, must be received in the office of the County Manager on or before the above stated date. In the event more than one upset bid is filed, the first upset bid received shall govern and all subsequent upset bids received shall be returned to their respective bidders. Upon receipt of an upset bid in compliance with the foregoing provisions, the property will be advertised again for additional upset bids, under the same procedure as set forth above, which procedure shall continue until no further upset bid has been received.
Upon the completion of all required upset bid periods the final offer received will be presented to the Alleghany County Board of Commissioners, which may accept the offer or reject the same. In the event the offer is rejected, the County may elect to sell the property again under the above stated procedure or under any other lawful procedure as permitted by Article 12, Chapter 160A, North Carolina General Statutes. In the event the offer is accepted, closing on the same must take place within thirty (30) days of said acceptance.
